1. Payment Policy

• Full payment is required at the time of registration to confirm the booking.

• All fees are subject to 5% UAE VAT.

• Payments can be made only by Cash, Debit Card, Credit Card, Bank Transfer, Payment Link, or the Academy’s official online payment system.

• Registration is confirmed only after successful payment.

• Registration fees (if applicable) are non-refundable.

2. Membership Reservation Policy

• Once a member starts their classes, a dedicated place is reserved exclusively for them until the membership expiry date.

• The reserved place is assigned based on the member’s age group, swimming level, class schedule, and coach.

• This reserved place remains unavailable for other students throughout the active membership period, regardless of the member’s attendance.

• Since the Academy reserves this space exclusively for the member, unused classes cannot be refunded due to absence, travel, personal schedule changes, illness (unless covered by the freezing policy), loss of interest, or any personal reason.

• Memberships, classes, packages, registration fees, and promotional offers are non-transferable unless approved by the Academy’s Management.

3. Refund Policy

• All payments made to Modern Swim Academy are final and non-refundable.

• Refunds will not be issued for unused classes or partially used memberships.

• If Modern Swim Academy cancels a class due to operational reasons, a replacement class will be arranged.

• Any request submitted to Management regarding membership matters will be reviewed and responded to within fifteen (15) working days.

4. Attendance, Cancellation & Make-up Policy

• Members are expected to attend all scheduled classes regularly.

• If a member cannot attend a class, the Academy must be notified at least 24 hours before the scheduled lesson.

• Any absence without prior notice of at least 24 hours will be considered a Late Cancellation / No Show, and the lesson will be deducted from the membership.

• Late cancellations affect class planning and prevent the Academy from offering the reserved place to another student.

• Each member is entitled to a maximum of two (2) make-up classes per calendar month, subject to schedule availability.

• Make-up classes are subject to available spaces and are not guaranteed.

• Make-up classes cannot be carried forward to the following month.

• Make-up classes do not extend the membership expiry date.

5. Membership Validity

• Membership validity starts from the registered start date.

• All classes must be completed before the membership expiry date.

• Any remaining unused classes after the expiry date will automatically expire.

• Membership validity cannot be extended except under the official Freezing Policy.

6. Coach & Schedule Policy

Modern Swim Academy reserves the right to:

• Change the assigned coach.

• Change class timing.

• Merge or divide classes.

• Change pool locations when operationally required.

Coach changes may occur due to:

• Coach absence.

• Staff scheduling.

• Student level progression.

• Long student absence.

• Package freezing.

• Educational recommendations from the Head Coach.

• Any operational requirements.

7. Freezing Policy

Freezing requests are accepted only through the Academy’s official WhatsApp or Email.

Medical freezing requires:

• A valid medical report or medical certificate.

• Submission before the membership expiry date.

Freezing allowances:

• 1-Month Membership: No freezing.

• 3-Month Membership: Up to 25 days.

• 6-Month Membership: Up to 60 days.

Required information:

• Student Name

• Registered Mobile Number

• Requested Number of Days

• Reason for Freezing

Approved freezing extends only the membership expiry date by the approved number of days.

8. Promotional Offers

• Promotional packages, discounted memberships, events, camps, and special offers are governed by their own conditions.

• Missed or cancelled classes under promotional offers are not eligible for replacement unless specifically stated.

• Promotional prices apply only during the announced campaign period.

• Previous offers or discounts do not guarantee the same price upon renewal.

9. Safety Policy

• Members and parents are responsible for their own safety and the safety of their children outside the designated swimming pool and training areas.

• Parents are responsible for supervising their children before and after lessons.

• Members must follow all safety instructions issued by Academy staff.

• Modern Swim Academy is not responsible for loss, theft, or damage of personal belongings.

• The Academy reserves the right to refuse participation to anyone whose behavior may endanger themselves or others.

10. Transportation

• Transportation services are available only after confirmation by the Academy.

• Transportation schedules may change according to operational requirements.

• The Academy is not responsible for transportation services arranged outside its official channels.

11. Photo & Media Consent

Unless the parent or member submits a written request refusing media usage, Modern Swim Academy reserves the right to use photographs or videos taken during classes, events, competitions, or camps for promotional, educational, and marketing purposes without additional compensation.

12. Force Majeure

Modern Swim Academy shall not be liable for interruptions, postponements, schedule changes, or temporary closures resulting from circumstances beyond its reasonable control, including but not limited to:

• Government decisions.

• School closures.

• Public health measures.

• Weather conditions.

• Pool maintenance.

• Technical failures.

• Utility interruptions.

• Any other force majeure events.

In such cases, the Academy may reschedule classes or apply appropriate operational solutions without creating any entitlement to refunds.

13. General Terms

• Any exceptional request remains solely at the discretion of Academy Management.

• Modern Swim Academy reserves the right to amend these Terms & Conditions at any time without prior notice.

• Failure to use the membership does not entitle the member to any refund, extension, or compensation except as provided in this policy.

• Members are required to comply with all Academy rules, safety procedures, and staff instructions.

• Any abusive, inappropriate, or unsafe behavior by members or parents may result in suspension or termination of the membership without refund.

14. Acceptance of Terms

By completing the registration form, making payment, or attending any class, the member (or parent/guardian) confirms that they have read, understood, and accepted these Terms & Conditions.

If the registration form is not completed, and no objection to these Terms & Conditions is received within twenty-four (24) hours after payment, payment and participation in the program shall constitute full acceptance of these Terms & Conditions.
